Australia’s move to restrict the adverse use of genetic test results in life insurance underwriting is more than a consumer health issue.
For business owners, directors and partners, it may influence how confidently they approach cover that protects debt, ownership succession and the financial impact of losing a critical person.

The reform is aimed at removing a long-running concern: that people might avoid genetic testing because a result could later affect their ability to obtain life insurance. In a business context, that concern can be especially sensitive. A founder considering testing for an inherited condition may also be the person whose cover supports a loan facility, a shareholder agreement or a continuity plan. If fear of underwriting consequences delays medical testing, both personal health decisions and commercial risk planning can suffer.

For SMEs, the practical message is not that underwriting becomes irrelevant. Insurers will still assess many factors, including age, current health, medical history, occupation, lifestyle, policy type and the amount of cover being requested. Business-owned or business-purpose policies can also involve financial underwriting, where the insurer checks whether the requested benefit aligns with revenue, debt exposure, ownership value or the economic contribution of the insured person.

That means the reform should be seen as a prompt to review, not a reason to assume cover is automatic. Businesses with older policies, informal succession arrangements or cover based on outdated valuations should revisit whether their insurance still matches current risks. This is particularly important where revenue has grown, borrowings have changed, a new partner has joined, or the business has become more dependent on a small number of people.

Three areas deserve attention:

  • Whether existing policies properly address key person risk, including profit disruption, recruitment costs and client retention pressure.
  • Whether buy-sell funding reflects the current ownership structure and an agreed valuation method.
  • Whether debt protection remains adequate where directors have given guarantees or the business relies on one person’s relationships to maintain cash flow.

Business owners should also remember that sums insured are commercial estimates, not guesses. Before seeking or updating cover, it can help to estimate the amount of cover required by considering profit contribution, liabilities, replacement costs and the likely disruption period.

The broader lesson is that life insurance planning is becoming more closely linked with health, governance and business continuity. Genetic testing reform may reduce one barrier to engagement, but the core discipline remains the same: identify who and what the business depends on, quantify the financial exposure, and ensure the insurance structure is aligned before a claim event tests the plan.
