Truck Claim Dispute Shows Disclosure Evidence Matters

AFCA ordered a commercial motor policy reinstated after the insurer could not prove a disclosure breach

A recent Australian Financial Complaints Authority decision involving a vandalised Hino truck is a useful reminder that disclosure disputes in commercial motor insurance turn on evidence, not assumptions.
Reported by insuranceNEWS.com.au on 15 October 2026, the matter ended with Suncorp being ordered to reinstate the policy and reassess the claim after AFCA found the insurer had not proved that undisclosed driving history would have justified refusing the risk.

The dispute concerned a commercial motor policy arranged via a broker. Suncorp had declined the vandalism claim, arguing that relevant driving and criminal histories had not been disclosed before the policy commenced. The insured disputed that position and also sought additional truck hire costs while the vehicle was off the road.

AFCA’s reasoning is significant for truck operators because it focused on how the insurer reached its decision. The authority found that Suncorp relied partly on answers recorded in the certificate of insurance, but the certificate appeared to have been issued after the policy started and there was no evidence showing how those answers had been obtained. AFCA also considered the insurer’s underwriting material and found the available evidence did not show that the information, if disclosed, would have led to the policy being declined.

One practical point was the treatment of licence suspensions across multiple drivers. AFCA found that the insurer’s question referred to any person likely to drive the insured vehicle, which indicated a driver-by-driver assessment rather than adding together the histories of several people. In this case, the authority was not satisfied that the threshold relied on by the insurer had been met by any one nominated driver.

For owner-drivers and fleet operators, the lesson is not that driver history is unimportant. It remains a central underwriting factor for commercial truck insurance. The lesson is that records should be clear at every stage:

  • which drivers are nominated or likely to drive the vehicle;
  • what licence suspensions, convictions or claims histories have been declared;
  • who supplied the information and when;
  • whether the proposal, schedule and certificate are consistent; and
  • what hire vehicle, downtime or replacement vehicle wording actually applies.

During a claims process, those details can become decisive. A claim may involve the vehicle damage itself, disputed policy cancellation, premium adjustments, hire costs and the insurer’s internal underwriting rules. Where records are incomplete, both sides may face avoidable delay and uncertainty.

The ruling also matters for brokers and insurers. It reinforces the need for careful file notes, clear proposal questions and a transparent link between an alleged non-disclosure and the underwriting outcome. For transport businesses, it is a timely reason to review driver declaration procedures before renewal rather than waiting until a claim exposes a paperwork gap.
