Australia’s life insurance sector is moving closer to a major change in how genetic information is treated during underwriting.
The Federal Government has been progressing a legal ban on the use of adverse genetic test results in life insurance assessments, replacing the industry’s current self-regulated approach with stronger consumer protections.

For business owners considering key person insurance, the development matters because underwriting confidence is central to arranging cover. A key person policy is often designed to protect a company if a founder, director, senior salesperson or technically essential employee dies or suffers a serious insured event. If people avoid health screening or genetic testing because they fear future insurance consequences, both personal wellbeing and business planning can suffer.

The proposed change is intended to reduce that hesitation. In practical terms, it should mean Australians can undertake clinically useful genetic testing without worrying that an adverse result will automatically work against them when applying for life insurance. That may be particularly relevant for trauma, total and permanent disability, income protection and life-style cover, where medical underwriting can be detailed.

However, businesses should not interpret the reform as a reason to delay protection planning. Underwriting will still consider many other factors, including age, occupation, medical history, lifestyle, policy type and the amount of cover requested. Insurers are also likely to keep refining application questions, evidence requirements and pricing models as the new rules are implemented.

For key person cover, the bigger lesson is that insurance should be structured around the financial risk to the business, not simply the easiest amount to apply for. Owners should consider:

  • how much revenue or gross profit depends on the key person;
  • whether business loans, investor commitments or personal guarantees need support;
  • the likely cost of recruitment, temporary contractors and client retention;
  • whether life, TPD and trauma-style benefits are all relevant;
  • how policy ownership and tax treatment may affect the outcome.

This is where careful modelling can help. Businesses may need to estimate an appropriate level of cover before speaking with insurers or advisers, especially if several people are critical to continuity.

The genetic testing reform is a positive trust signal for the life insurance market. It does not remove the need for transparent advice, accurate disclosure or regular policy reviews, but it may make more Australians feel comfortable seeking medical insight without compromising future protection. For businesses, that supports a healthier balance between responsible risk management and fair access to cover.
