Claims Code Reform Keeps the Spotlight on Liability Cover

What small businesses can do now to be better prepared if a third-party claim occurs

Claims Code Reform Keeps the Spotlight on Liability Cover?w=400

Renewed attention on reforms to Australia's General Insurance Code of Practice is a useful reminder that the quality of an insurance policy is tested most clearly when a claim is made.
For small businesses, sole traders, tradies and event organisers, that moment can be stressful, time-sensitive and financially significant, especially where a customer, supplier or member of the public alleges injury or property damage.

The code review process has placed claims communication, transparency, vulnerability support and complaint handling under scrutiny. While much of the public debate often focuses on home and motor insurance, the same service principles matter for businesses that rely on liability cover to respond to third-party claims. A delayed response, unclear request for documents or uncertainty about policy conditions can make an already difficult incident harder to manage.

This latest development builds on the earlier focus on service standards across the general insurance sector. For business owners, the practical message is not to wait for reform before improving their own claims readiness. Good preparation can reduce confusion, support faster assessment and help avoid avoidable disputes about what happened, when it happened and what steps were taken afterwards.

Public liability insurance generally responds to covered claims involving third-party injury or property damage connected with business activities, subject to the policy wording, exclusions and limits. However, cover is not automatic simply because an incident occurred. Insurers commonly need prompt notification, incident details, witness information, photos, repair invoices, correspondence and evidence that reasonable steps were taken to prevent further loss.

Businesses can use the current claims service debate as a reason to check three practical areas. First, review who in the business is responsible for reporting incidents and where records are stored. Second, check whether contracts, leases, venue agreements or principal contractor arrangements require a particular cover limit or certificate of currency. Third, make sure staff know not to admit liability or negotiate compensation before the insurer has been notified.

For higher-risk businesses, such as construction contractors, hospitality venues, gyms, markets, mobile service providers and businesses working at client premises, the review is also a prompt to consider whether current limits still match the exposure. A single serious injury claim can involve legal costs, medical evidence and compensation issues that exceed everyday expectations.

If your business has changed locations, taken on larger contracts, increased public foot traffic or expanded into events or subcontracting, it may be worth considering taking the time to compare policy terms or request a fresh public liability insurance quote. Service standards are important, but the best claims experience usually starts before the claim: with suitable cover, clear records and a business that understands its obligations.
