New Zealand’s long-running insurance contract law reform is shifting from a technical legal issue into something everyday policyholders need to understand.
The Contracts of Insurance Act modernises rules that have sat behind insurance policies for generations, including how customers disclose information, how insurers respond to non-disclosure, and how certain policy terms are treated.

For people considering Income Protection Insurance, the reform matters because these policies are highly dependent on personal circumstances. Occupation, income structure, medical history, past injuries, medication, hours worked and whether someone is employed or self-employed can all affect underwriting and claims. If those details are misunderstood or poorly recorded, the consequences can be serious when a claim is made.

A central theme of the new framework is clearer, fairer handling of customer disclosure. Rather than placing all the weight on consumers to guess what an insurer might consider important, the regime is designed to support more focused questions and more proportionate outcomes where errors occur. That should encourage insurers to improve application forms, adviser processes and policy communications.

This does not mean disclosure becomes optional. Income protection customers will still need to answer carefully, update information when required, and keep records of what was supplied. However, the direction of travel is towards a system where policyholders should be better guided at the point of sale, and where the response to a mistake should better reflect its significance.

There are several practical takeaways for anyone reviewing cover:

  • Check whether your current benefit amount still reflects your actual earnings and essential expenses.
  • Review waiting periods, benefit periods, exclusions and offsets, not just the premium.
  • If your income varies, especially as a contractor or business owner, keep tax, invoice and accounting records in good order.
  • Ask how a pre-existing condition, past claim, reduced hours or changed occupation may affect future cover.

Self-employed New Zealanders should pay particular attention. Income protection can be harder to assess when revenue fluctuates or business and personal income overlap. Before applying or changing cover, it can be useful to estimate an appropriate monthly benefit and then test whether that amount would realistically protect rent or mortgage payments, groceries, utilities, debt repayments and family commitments.

The reforms also reinforce the value of advice. Product wording, tax treatment, offsets and claim definitions can differ materially between insurers, so advice from a licensed adviser can help customers understand what is being bought and where the limitations sit.

Ultimately, the legal changes should support a healthier insurance market, but they are not a substitute for active policy management. Income protection is most valuable when it is accurate, current and understood before illness or injury interrupts earning capacity.
